These terms govern your purchase and use of AI-generated brand photography services from Framed by Elevated HQ ("Framed," "we," "us"), operated by Elevated HQ, a Texas-based company. By placing an order, you agree to these terms.

The service

Framed produces AI-generated brand photography and video based on source photos you upload and a creative brief you approve. Turnaround begins upon receipt of your approved brief and usable source photos.

Your responsibilities

You confirm that you own or have the right to use the source photos you upload, that they depict you (or a person who has given you permission), and that your brief does not request content that is unlawful, infringing, or impersonates another person. We may decline or cancel any order that violates these requirements.

Payment

All prices are in U.S. dollars. Payment is due in full at checkout and is processed by Stripe. Brand Membership is a recurring quarterly subscription at the rate of $297 that renews automatically until canceled; cancellation stops future charges, and access continues through the current quarter.

No refunds; one redo per order

All sales are final. Because every session is custom-produced to your brief, we do not issue refunds. Instead, every order includes one complimentary redo. If your delivered images do not reflect the brief you approved, reply to your delivery email within 7 days of delivery describing what was missed, and we will rerun the set at no charge on the same timeline as your original order.

A redo reruns your original brief and likeness. New concepts, wardrobe, backdrops, or changes in direction are a new order. One redo is included per order; the redo is where our guarantee ends. Initiating a payment dispute for work delivered under these terms constitutes a breach of this agreement.

Ownership and license

Upon full payment, you receive full commercial usage rights to your delivered images and video for your personal and business branding. You retain all rights to your likeness and your source photos. Framed retains the right to use anonymized, non-identifying aspects of production for service improvement, and will only feature your delivered images in our portfolio or marketing with your permission.

AI-generated content

Deliverables are AI-generated. Outputs are synthetic images styled to resemble you based on your source photos; minor variations from your actual appearance are inherent to the medium and, on their own, do not constitute a failure to match your brief. You are responsible for complying with any disclosure requirements that apply to your use of AI-generated imagery on specific platforms.

Limitation of liability

To the maximum extent permitted by law, Framed's total liability for any claim arising from an order is limited to the amount you paid for that order. We are not liable for indirect, incidental, or consequential damages, including lost profits or business opportunities.

Governing law

These terms are governed by the laws of the State of Texas. Any disputes will be resolved in the state or federal courts located in Texas.

Changes to these terms

We may update these terms from time to time. The version in effect when you place an order applies to that order.
